# TEZCATT Terms of Service - v2 reconciled draft

TEZCATT LLC is identified in the owner draft as a Colorado limited liability company. These terms cover the website, applications, APIs and research simulations. Use only the features actually offered in your account. A subscription does not license source code or authorize local institutional deployment.

## Accounts and existing safety protections

Provide accurate account information, protect credentials and do not transfer accounts or bypass access controls. An institutional signatory must be authorized to bind their organization. The draft's independent age-13 eligibility has not been adopted: existing parent/guardian-linked minor accounts, Child Safe Mode, direct-contact restrictions involving minors and age-restricted events remain in effect. Paid-beta eligibility and minors' purchasing rights require counsel review before sale.

## Incorporated consumer policies

Review Privacy (/legal/privacy), Subscription and Billing (/legal/subscription), Refund (/legal/refund), Community Guidelines (/legal/community), User Content and Research Data License (/legal/content-license) and DMCA/IP (/legal/dmca). The existing Code of Conduct (/legal/code-of-conduct) continues to apply. Confidentiality (/legal/nda) applies only to specifically identified non-public disclosures, subject to non-waivable rights. Institutional agreements require a separately executed contract.

## Scientific and aerospace limitations

TEZCATT is for scientific research, preliminary analysis, education and research simulation. It is not currently certified for flight operations, avionics guidance, live launch maneuvers, real-time conjunction assessment, spacecraft command/control or mission-critical navigation. Independently validate results; the restricted models and illustrative displays do not establish operational safety or fitness for a mission.

Do not upload or process export-controlled technical data in the commercial cloud service. TEZCATT does not claim ITAR/EAR certification or that using a local deployment establishes export compliance. Local deployment is not presently offered under a consumer subscription; any future authorization requires deployment-specific technical, security and legal review. See /legal/high-risk.

## Intellectual property and service use

You retain whatever rights you hold in your own inputs and original contributions, subject to the content license. Third-party/public data, imagery, software and source material keep their applicable licenses and attribution. A generated output does not confer ownership of those materials. TEZCATT retains its own software and trademarks. No right to redistribute third-party content or TEZCATT source code is implied. Do not violate laws, others' rights or technical safeguards.

## Service limits, payment and termination

The cloud beta is provided as available without a promised uptime or support response time. Research, Pro and standalone VR are separate offers governed by the billing and refund policies. Tips and merchandise are separate transactions and do not purchase Research or VR entitlement. Cancellation, refunds and suspension are distinct actions. Suspension for abuse or security concerns does not erase applicable consumer rights or financial records.

## Liability and applicable law - counsel review required

To the extent permitted by applicable law, the service is provided as is and as available without guaranteed accuracy or uninterrupted operation. The owner draft proposes exclusion of consequential and mission-related losses and a total liability cap equal to fees paid in the preceding twelve months. These proposed provisions require counsel review and do not exclude non-waivable liability or statutory consumer remedies. Colorado law is proposed, subject to applicable mandatory law.

## Changes and notices

Material policy updates require notice where applicable and a new version acknowledgement in the commercial beta. Previous acceptance records are retained. Public effectiveness, working notice contacts, refund terms and the liability provisions remain launch gates. No attorney approval is represented.
